Bold claim: An electoral misstep could tilt representative power, and Namibia’s ECN is acting fast to set it right. The Electoral Commission of Namibia (ECN) has filed an urgent self-review application with the Electoral Court of Namibia to correct a sequencing error made by a returning officer. The mistake involved allocating a council seat to a party that actually had fewer votes than another association that participated in the Rundu Town Council election.
The incorrect seat allocation was declared on Saturday, after the regional council and local authority elections were held the prior Wednesday.
In the local authority contest at Rundu, the Rundu Urban Community Association (Ruca) earned 674 votes and won one seat. However, the returning officer incorrectly gave that seat to the Independent Patriots for Change (IPC), which received 642 votes.
In a statement released on Tuesday evening, the ECN explained that, since the decision originated from its designated official, the commission no longer claims jurisdiction to adjust the matter without court intervention. A competent court is now required to review the returning officer’s decision and either uphold or overturn it.
Chief electoral and referenda officer Peter Shaama emphasized that the ECN is pursuing the legal route to safeguard the integrity of the electoral process. He noted that the affected parties were brought into the loop via an urgent meeting on Tuesday.
Shaama outlined the Rundu local authority’s composition: seven council seats were available, with a total of 12,560 votes cast. Using the quota method, one seat equaled 1,794 votes. Swapo secured 7,148 votes, translating to four seats; the Rundu Concerned Citizens’ Association (RCCA) amassed 1,337 votes, earning one seat; and Affirmative Repositioning (AR) garnered 799 votes, securing one seat. Ruca trailed with 674 votes, while IPC had 642—the lowest tally.
According to Shaama, the returning officer’s error arose when the final seat was awarded to IPC instead of Ruca, despite Ruca’s higher vote total. He described this as a clear misallocation that must be corrected to reflect voters’ will.
The ECN’s move demonstrates its commitment to transparency and to ensuring that seat distributions on the Rundu Town Council accurately mirror the electorate’s preferences. This action follows a prior self-review filed last month after a Swapo candidate in Nkurenkuru was erroneously declared the winner while another candidate had been listed as a participant in the election.
